採購官員的落差 國立東華大學新建宿舍工程進度落後，導致學生無法在開學前入住，校方並開會決議延後1週開學。有讀者投書建議參考美國聯邦採購法規提供趕工獎金，行政院公共工程委員會的回覆是美國聯邦政府的「聯邦採購規則（Federal Acquisition Regulations，FAR）」，並無投書所稱的內�ehttp://money.chinatimes.com/news/news-content.aspx?id=20110914002042&cid=1206。這一件舊聞相當的令人駭聞，因為在FAR Subpart 37.6—Performance-Based Acquisition即有該新聞所述的趕工獎金法源，如下：
37.600 Scope of subpart. 37.601 General. (a) Solicitations may use either a performance work statement or a statement of objectives (see 37.602). (b) Performance-based contracts for services shall include— (1) A performance work statement (PWS); (2) Measurable performance standards (i.e., in terms of quality, timeliness, quantity, etc.) and the method of assessing contractor performance against performance standards; and (3) Performance incentives where appropriate. When used, the performance incentives shall correspond to the performance standards set forth in the contract (see 16.402-2). (c) See 12.102(g) for the use of Part 12 procedures for performance-based acquisitions. 聯邦各採辦單位則須依據FAR就其採購類型自行訂定相關的performance standard，例如在國防體系就有訂定如下的“Guidebook for Performance-Based Services Acquisition (PBSA)” https://www.acquisition.gov/comp/seven_steps/library/DODguidebook-pbsa.pdf ，摘錄其中二項範例供參考， Page 14: Schedule incentives: Schedule incentives focus on getting a contractor to exceed delivery expectations. They can be defined in terms of calendar days or months, attaining or exceeding milestones, or meeting rapid-response or urgent requirements. Page 10: Examples of Performance Standards • Response times, delivery times, timeliness – meeting deadlines or due dates, adherence to schedule. • Error rates – number of mistakes/errors allowed in meeting the performance standard. • Accuracy rates – similar to error rates, but most often stated in terms of percentages. • Completion milestone rates – x percent complete at a given date. • Cost control – keeping within the estimated cost or target cost. Applies in cost-reimbursement contract arrangement. 政府官員該多讀點書，否則會敗壞國家。 |

Re: 採購官員的落差 即使東華大學想要在進度落後時，給incentive，來激勵廠商也無濟於事，因為合約簽的方式不同，若要中途改變，雖可修約，但要注意到是否有圖利廠商之嫌，另外，東華大學有沒有錢可以這麼做，也是問題。
當然美國的購規是不是我們可以師法的，該有人去研究，但短期內，恐怕也很難有一個定論。 而就算真的可以給incentive，如何制定績效標準，又會是另一個要探討的問題了... performance incentive是否可以稱為趕工獎金，就字面而言，確實很難做出認定，但performance指績效、表現、效能，而又可以定出相關的performance standards，而schedule亦僅是performance standards中間的一項而已...時程上的優異表現，不見得是趕工，有可能是因為改變了工法、技術而獲得的成果，而不是採用人海戰術的方式。以建築而言，水泥乾不乾得了，需要時間，材料能不能準則送達工地，有採購的問題，也有運輸的問題，甚至於是廠商自己內部資源調度的問題... 但不論如何，都是值得討論的議題
